Terms of Service

1. Who these Terms cover

These Terms govern your access to and use of Calometer, including the iOS app, website, API, account features, AI meal analysis, nutrition logging, Apple Health integration, notifications, and paid subscription features.

By creating an account, signing in, purchasing a subscription, or using Calometer, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and health disclaimer

You must be at least 18 years old, or the age of legal majority where you live, to use Calometer. Do not use the app for a child or dependent without legal authority and appropriate professional guidance.

Calometer is a calorie and nutrition tracking tool, not a medical device or healthcare provider. AI estimates, goals, trends, calories, macros, and activity summaries are informational only and may be inaccurate. Always consult a qualified medical professional before making diet, weight, exercise, or health decisions.

3. Accounts and sign-in

You can sign in with supported providers such as Apple or Google. You are responsible for keeping your account and device secure and for all activity under your account.

You must provide accurate information and must not impersonate another person, create accounts for abuse, bypass device signing, interfere with authentication, or attempt to access another user’s data.

4. What the service does

Calometer lets you photograph meals, optionally add notes, receive AI nutrition estimates, confirm or adjust entries, log food, water and weight, set profile goals, view trends, connect Apple Health active-energy data, and receive reminders if you enable notifications.

Food-search and barcode features may use public food databases such as Open Food Facts as a fallback. Third-party nutrition data can be incomplete or wrong, so you are responsible for reviewing entries before relying on them.

5. Meal photos, notes, and user content

You keep ownership of photos, notes, custom foods, logs, and other content you submit. You grant us the limited rights needed to host, process, transmit, analyze, cache, display, secure, debug, and improve the service for you.

Do not upload photos or content that you do not have the right to use, that contains another person without permission, or that is illegal, harmful, abusive, sexually explicit, or intended to test or bypass safety systems.

6. AI estimates and accuracy

AI meal analysis is probabilistic. It can misidentify foods, ingredients, allergens, portion sizes, calories, macros, or other nutritional values. You must check and adjust the result before treating it as part of your diary.

We do not promise that estimates will match lab-tested values, food labels, restaurant data, medical targets, or professional advice. You are responsible for how you use the information.

7. Apple Health and device integrations

Calometer may ask permission to read active-energy samples from Apple Health. Apple Health access is optional and controlled by your device settings. If you revoke permission, health-derived widgets may stop working.

We do not write workout, nutrition, or medical records to Apple Health in the current app. Apple and Google sign-in, Apple Health, App Store subscriptions, RevenueCat, Expo notifications, and other platform services are also governed by their own terms.

8. Subscriptions, billing, cancellation, and refunds

Paid features are sold as auto-renewing subscriptions through Apple’s App Store and managed through RevenueCat. Prices, trial availability, renewal periods, taxes, and billing terms are shown before purchase in Apple’s purchase sheet.

Subscriptions renew automatically unless you cancel through your Apple ID or App Store subscription settings before the renewal date. Uninstalling the app, stopping use, or deleting your Calometer account does not cancel App Store billing.

Calometer does not issue refunds for unused time, non-use, accidental renewals, dissatisfaction, or failure to cancel before renewal. Refund requests must be submitted to Apple and are decided by Apple under App Store rules.

9. Acceptable use

• Do not reverse engineer, scrape, overload, attack, tamper with, or bypass rate limits, signatures, paywalls, subscriptions, authentication, or security controls.
• Do not use Calometer to build a competing dataset or model, benchmark abusive workloads, automate account creation, or resell service output.
• Do not submit content that infringes rights, violates law, or includes sensitive images of people who have not consented.
• Do not use the service for emergencies, diagnosis, eating-disorder management without professional supervision, or any regulated medical purpose.

10. Account deletion

You may request account deletion in the app. Deletion removes sign-in access, sessions, linked auth accounts, device keys, push tokens, notification settings, and RevenueCat customer data where supported.

Some nutrition logs may remain as anonymized records after direct identifiers and stored photo links are removed, unless we must keep limited information for legal, security, fraud-prevention, accounting, or dispute reasons. Account deletion does not cancel an Apple subscription or create a refund right.

11. Service changes and availability

We may add, change, limit, suspend, or discontinue features at any time, including AI models, subscription entitlements, food sources, notification behavior, and integrations. We do not guarantee uninterrupted or error-free service.

We may suspend or terminate accounts that violate these Terms, create risk, misuse the service, or expose us, users, or providers to legal, security, or operational harm.

12. Intellectual property

Calometer, the app, website, software, design, branding, prompts, workflows, and service output format are owned by us or our licensors. These Terms grant you a personal, limited, revocable, non-transferable license to use the service as intended.

13. Disclaimers and limitation of liability

The service is provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and health outcomes.

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential, punitive, lost-profit, health-related, data-loss, or subscription-billing damages. Our total liability for any claim is limited to the amount you paid for Calometer during the three months before the event giving rise to the claim, or USD $50 if you paid nothing.

14. Apple-specific terms

For the iOS app, Apple is not a party to these Terms and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, under App Store rules.

Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. Your use of the app must also comply with the App Store rules and the Apple Media Services Terms and Conditions.

15. Changes and contact

We may update these Terms by posting a new version and changing the “Last updated” date. If changes are material, we will provide reasonable notice in the app, by email, or on the website when practical.
